Sociology - Essay Example While adult crime rates remains comparatively stable, the number of violent crimes committed by juveniles has skyrocketed over the recent decades. Thus, between 1988 and 1994 the rate of juvenile arrests for violent crimes has risen by 75 percent, which makes many experts project doubling of the rate by the end of this decade (Snyder, Sickmund, and Poe-Yamagata, 1996). Crime is potentially preventable ââ¬â or at least controllable ââ¬â social phenomenon, but the only key to its prevention is knowledge of the causes of youthful offending. Impressive number of studies performed up to date reveals that although many factors contribute to the making of a delinquent child, negative peer associations always remain arguably the major source of juvenile delinquency (Andrews, Hoge, and Leschied, 1994: 556). The present study aims to empirically establish and measure correlation between negative peer associations and high occurrence of delinquent behavior in teenagers. Although the potential findings of this research are of minor theoretical importance ââ¬â comprehensive expert studies have already established and explained the nature of both short- and long-term correlation between negative peer associations and juvenile delinquency ââ¬â their practical value in predicting juvenile delinquency rates and defining risk groups should not be diminished. The correlation may significantly vary depending upon many factors, such as religion, age, traditions, etc., and only data relating to concrete environment has reliable predictive power and can be used for prevention of juvenile delinquency. Positive correlation between juvenile delinquency and negative peer associations has been explored in many studies. The most common approach adopted by the scholars is the social learning theory: behavioral patterns are learned from social interactions (direct learning) and observation (indirect learning) (Bandura, Ross, and Ross, 1961). Business research methods - Essay Example Times have changed. People want more. Factors such as job satisfaction, pay, and contributions to the overall business are all influential in employee productivity, but it is the managers, the mid-level managers, that have the biggest influence over employee productivity. Incentive programs may be one of the most common forms of monetary compensation for Productivity. The use of incentives may be viewed to have a positive influence on employee attitudes and behavior. A number of private sector companies use monetary compensation as a way to influence its employees to perform at a higher level. Bonuses can be given to those employees that perform at a consistently high level. Incentive programs structured with employee input work best. Long-term incentives are more powerful than short-term incentive and certainly can lead to high motivation level among employees and lead to production. "If you begin rewarding for specific behavior, the purpose of that behavior becomes the receipt of rewards rather than the personal benefits of behaving in that manner. Incentives should be used to engender employees to be safe. You want to encourage an overall philosophy of safe behavior." (Billsims.com) Although increased wages are important, the perceived value of money varies among employees. There are also many other factors that can influence whether monetary incentives will have the desired motivational effect. Incentive or gain-sharing programmes often fail to produce expected results when employees think the programme is unfair. Outside factors can influence employee production. Other issues such as family disputes or crisis, emotional instability (depression), media perception of an agency etc, all affect employee production. ââ¬Å"While healthy competition is a benefit to the agency, there is no need to create a hostile work environment because of resentment and animosity. Tension in the workplace can definitely cause employees to be less

How Stalin Became The Leader Of The Soviet History Essay
How Stalin Became The Leader Of The Soviet History Essay The purpose of this paper is to examine how Stalin became the sole leader of the Soviet Union while he was regarded to the Politburo as a minor player who had no chance of defeating Trotsky. Was Stalin politically strong from the beginning of this power struggle? Did Trotsky even want to become the Soviet Unions sole leader? To what extent were Stalins opponents weak during the power struggle? Were there any external factors that led to Stalins rise for power? Was there any luck involved in this event? These questions would be examined or answered in the investigation. This essay focuses on the time period from 1924- the start of Soviet Russias political power struggle- to 1929, Stalins formal role of totalitarian dictatorship. This paper draws on a verity of primary source diary material, newspaper articles, secondary source books and periodical articles which serve as some historiography for analyzing the critical issue of how clever and cunning was Stalin in this power struggle. This has been a subject of debate over many historians since Lenins death and the debate is examined in this paper. This paper concludes that a combination of Stalins political skills and his personality caused Trotsky to be eliminated during the power struggle while Stalin became the sole leader. Due to the complexity of events, we cannot determine whether this factor could be played out by itself however, most renowned historians share the same views with the factor of Stalins political skills being the most important cause that led to his uprising. Introduction In 1924, a massive political struggle occurred in the Soviet Union. Vladimir Lenin, leader of the former Bolshevik Party and the Communist Party of the Soviet Union, died on the 21st of January in 1924.à [1]à Lenin had held the party together since 1917 and had been the central person to determine its policies.à [2]à Without providing a clear successor, he left the party in chaos and the in-fighting and division could jeopardize or pull apart the Communist Party. Lenins death did not occur at the right time and there were issues that the Soviet Union faced regarding to the route towards socialism, leadership in the party and the problems of a growing bureaucracy.à [3]à There were many conflicts between the key party leaders personalities and this led to a struggle over power that lasted for the next five years. This has led some historians to call it a struggle over power, rather than for power since the Politburo members priority was keeping each other out of power rathe r than gaining power for themselves.à [4]à Joseph Stalin was regarded as a minor player in the beginning and Trotsky was famously named as the chief contender of this massive power struggle. Trotsky was the most prominent and power Bolshevik leader since he was the commander of the Red Army from 29 August 1919 to 15 January 1925. However in 1929, Joseph Stalin emerged as the sole leader of the power struggle. Although historians readily acknowledge Stalin as the sole leader in 1929, the question remains on how was Stalin able to become the Soviet Unions sole leader while he was regarded as a minor player who had no chance in defeating Trotsky. Two main interpretations dominated the debate over the relationship between Stalins political skills and the weaknesses of his opponents. Many historians hold the conviction that Stalins political skills were too ruthless as Stalin himself admitted, Yes, I am rough, rough on those who roughly and faithlessly try to destroy the Communist Party.à [5]à On the other hand, different historians seek to dissociate Stalins personality from Trotskys weaknesses. Those historians argued that Trotsky had no talent or tactic and had no intention to fight in the battle for power in the first place. The purpose of this essay is to evaluate the factors that led to Stalins rise to power over Trotsky. Though Stalin had a ruthless character, he was named Russias third most popular historical figure in a nationwide poll despite the famine and purges that marked his rule.à [6]à The essay examines Stalins political skills and personality, and the weakness of his opponents. Based on the result of this examination, it is possible to conclude that although Trotsky was the most powerful candidate, the nature of Stalins personality and actions were noticeably stronger than Trotsky. Stalin had much desire and motivation to get to the top. Therefore, this essay will argue that the most significant reason for Stalins uprising is his political abilities and personality. This investigation is worthy to examine because it may become a reference to future power struggles that are similar to Stalins rise of power. After examining this topic, one can acknowledge that successful candidates must h ave a strong personality along with potential abilities that reaches the high expectations of this criterion. 1. Stalins Political Skills and Personality The most dominant factor that led to Joseph Stalins success as the sole leader was his political skills and personality. This point of view is shared by many historians and they tend to dissociate Leon Trotsky from the question of having no talent. Historian J.N. Westwood argued that Stalin was immensely cunning and wrote that Stalin stood back and watched his rivals dig their own graves, likening his actions to a dog that steals a bone when two others are fighting over it.à [7]à This source is valuable because it was exactly what happened during the power struggle as Stalin swayed from the left wing to the right wing to eliminate all his opponents by the end of 1929. A former Politburo member, Nikolai Bukharin, also agreed that Stalin was ruthless and in his book, he wrote, Stalin is a Genghis Khan, an unscrupulous intriguer, who sacrifices everything else to the preservation of powerà ¢Ã¢â ¬Ã ¦ He changes his theories according to whom he needs to get rid of next.à [8]à Hence, we can state that Stalins political personality played a significant role in the history of the power struggle. Bukharin, a former contender in the political battle can give us important historical answers however there are limitations. Since he was Stalins opponent, he would probably have his own views and therefore one can conclude that his historical information may be biased. There also seemed to be a minority opinion. Author, Theodore VonLaue disagrees with the major views and writes, What he (Stalin) lacked were the very qualities in which the former exiles excelled.à [9]à One can refute Theodores point with major evidence from trusted historians therefore it seems that Stalins political skills were the most important reason for the downfall of Trotsky. One of the most obvious advantages Stalin had over Trotsky was his immense positions of power gained with his political skills and personality. As, historian Chris Ward writes, Stalins personality cannot be divorced from the world in which he functioned.à [10]à Stalin was appointed head of the Workers and Peasants Inspectorate, in command of the Orgburo and he was a newly elected member of the Politburo which became the main organ of power.à [11]à In March 1919, Yakov Sverdlov died of Spanish flu and Lenin was left with a few top administrators to replace Sverdlov. At that time, Stalin had gained Lenins trust (since Stalin appeared very loyal to Lenin) and Lenin clearly did not want all the powers in one hands since Trotsky was already the Red Armys commander. Therefore, he appointed Stalin over Trotsky as the partys first General Secretary whom was in charge of the general organization.à [12]à Other Bolsheviks saw these jobs as a part of the dull routine of party bureauc racy and paid little attention to him which gave Stalin an enormous advantage as the Grey Blur in the battle for power.à [13]à Having the position of a General Secretary was a crucial factor for the rise of Stalin. Stalin had control over every step of the hierarchy as he controlled the first step of ladder. He had the privilege to appoint new members who owed him their loyalty. Therefore having the title, General Secretary was effective to place supporters in key positions to win and deliver votes that outmaneuvered political opponents. Stalin could also set the agenda for the Politburo meetings so he controlled what the politburo talked about. Furthermore, he controlled the leaflets which meant that he had power over the enemies political image. Stalin was basically in control of the whole Political Machine in USSR after Lenins death. After Lenins death, Stalin rose in power because of his cunning manipulative personality and it was shown in the event of Lenins Funeral. One can clearly tell how significant and effective Stalins skills because he wanted to portray himself as the legitimate successor and destroy Trotskys positive image as Lenins chosen successor. Lenin died on the 21st of January 1924 and his funeral was held six days after his death in the Red Square.à [14]à The cult of Leninism had just begun after the Red Terror and Stalin gave it momentum at Lenins Funeral by acting as a pallbearer and giving the oration with an oath of loyalty made to Lenins legacy.à [15]à Stalin had contacted Trotsky, whom was resting in South Russia because of his illness. Having a cunning personality, Stalin convinced Trotsky to not attend Lenins Funeral because he would not been able to arrive on time and by accepting Stalins proposal, Trotskys image was heavily injured. At the end of the Funeral, Stalin had a very successful outcome because the general public had the impression that he was designated to become Lenins successor since it looked like he was taking on the Mantle of Leninism.à [16]à This event showed how Trotskys weaknesses were exploited by Stalin and used to gain better credibility. This event provides an overwhelming amount of evidence of how Stalin applied his clever but sinister tactics and it reflected on Stalins true personality. From 1922 onwards, Stalins true personality was gradually more transparent. Stalin posed as a moderate in the Communist Party spectrum between Trotsky on the Left wing and Bukharin on the Right wing in the early 1920s.à [17]à He had avoided making definite policy decisions until 1928. This allowed him to stay away from political disputes within the party and he would be able to gain the support from the Liberals and the Conservatives. Stalin used policy disagreements to outflank and isolate his opponents and successfully presented the views of his opponents as anti-communist or anti-Leninist. This highlighted how Stalin successfully manipulated Lenins Ban on Factions by using his cunning strategies into his advantages. Robert Conquest stated that, In six years Stalin outmanoeuvred a series of opponents; first in alliance with the rest of his colleagues, he opposed and demoted Trotsky. Then in alliance with the Bukharin-Rykov Right he defeated the Zinoviev-Kamenev Left blocà ¢Ã¢â ¬Ã ¦ and finally he and his own following attacked their hitherto allies, the Rightists.à [18]à Robert Conquest, a well known British historian, retold a section of the timeline when Stalin is rising to power. In ones opinion, Stalin was ruthless and did whatever it took to be the sole leader of Soviet Russia and historian R. Conquest along with Bukharin acknowledges Stalin switching sides with whoever he wanted to eliminate and evidently his cruel personality was exposed. However, Stalins strategy convinced people he was dull and mediocre, hence he was known as the Grey Blur which left no trace.à [19]à This valuable quote demonstrated Stalins strategic skills which gave him immunity to criticism because his personality was not known clearly. Sukhanov, the diarist of the revolution noted, Stalin however, during the course of his modest activity in the Executive Committee, gave me the impression-and I was not alone in this view, of a grey blur which flickered obscurely and left no trace. There is really nothing more to be said about him.à [20]à By examining Sukhanovs diary, we can state that Stalins political tactics gave him an opportunity to blend in the background. In another example, Deutscher had the same point of view in his review, He carefully followed the course of debate to see what way the wind was blowing and invariably voted with the majority, unless he had assured his majority beforehand.à [21]à Stalins personality had turned t he political battle into a nightmare and his perceived objective was simply to be the last surviving person in the Politburo by eliminating other players first using his gifts from Lenin. Stalin used his external circumstances created by Lenin, very wisely. By analyzing how he incorporated them to his advantage, we would be able to observe his political mindset. Policies like the Ban on Factions, the nomenklatura system and Lenins enrolment were clear examples. The ban on factions, created by Lenin in 1921, called for unity and an end to splits and factionalism as Lenin stated, All members of the Russian Communist Party who are in the slightest degree suspicious or unreliable should be got rid of and this was a massive advantage that enabled Stalin to get rid of his rivals easily after Lenins death.à [22]à The nomenklatura system was established from 1923 onwards and decision making only applied to a few hands in the Communist Party whom most of the voters were loyal Stalinists. The Lenins enrolment was a recruitment campaign that started in 1923 and it increased the Communist Party of the Soviet Union from 340,000 members to about 600,000 members by 1925. Althou gh Lenin Enrolment was supposedly for party purposes, General Secretary, Stalin, controlled or vetoed the party list for his own personal gain by placing his supporters in places of political power. These external circumstances were devastating weapons in the hands of Stalin whom could basically control the votes at party congresses. There had also been evidence of his ruthlessness in the 1922 Georgian Affair. Stalin was born in 1878 to a peasant Georgian cobbler family as Iosif Dzhugashvili and changed his name to Stalin as Man of Steel later on.à [23]à He grew up was a violent and lawless place and was frequently involved in brawls with other children.à [24]à Stalin lived a peasant life and he was uneducated but had a unique personality. Stalin hated Georgia and his harshness in imposing the Bolshevik rule on his native country, Georgia, shocked many people including Lenin.à [25]à Lenin wrote in his testament, Stalin is too rude.à [26]à Stalins daughter, Svetlana Alliluyeva had the same point of view and in an interview she said, He was a very simple man. Very rude. Very cruel. Svetlana also said, He broke my life. I want to explain to you. He broke my life twice.à [27]à Sources from Svetlana are very valuable and reliable since it was Stalins daughter and it provides a first persons point o f view on Stalins real personality. In Svetlanas memoir, Twenty letters to a friend she described her fathers personality and she wrote, At this point, and this was where his cruel, implacable nature showed itself, the past ceased to exist for him. Years of friendship and fighting side by side in a common cause might as well never have been.à [28]à Surprisingly, Stalins daughter had a very bad image of her father as she wrote, In his cold-blooded way he cared about only one thing. How is X conducting himself now? Does he admit his mistakes? This source informs us Stalins true personality. He himself did not admit to any wrongdoings and only blames it on his opponents. In ones opinion, he had a very cruel but strong personality and Svetlana has the same view, He is gone, but his shadow still stands over all of us. It still dictates to us and we, very often, obey.à [29]à Stalins personality was mainly caused by his background and he had learned life the hard way through an ind ependent life. Stalin was not considered an intellectual like Trotsky. However, he had the power to lead equals whom Trotsky lacked through manipulation and cunning. Stalins had no fear of behaving immorally or of getting this hands dirty and this contributed largely to his success in taking over the party by 1929.

Compare The Ways In Which Writers Tell Stories In The Following: The N :: essays research papers
The title of this essay states that I must include another text, of my choice. ââ¬ËThe Naval Sisters Taleââ¬â¢ is written in the form of a transcript, whereas ââ¬ËThe Obituary of Captain David Goodwinââ¬â¢ is in the form of an article. I wanted to choose something different to both of these texts, so along with these passages, I have chosen to incorporate ââ¬ËBack to the Army Againââ¬â¢ by Rudyard Kipling. I decided on this text as it has refrains (which I find particularly interesting and fun to say), also because I think it contains a sense of irony and holds an ambiguity within its simplistic structure. I shall start with ââ¬ËThe Obituary of Captain David Goodwinââ¬â¢. The first things that struck me about this particular text was the fact that it had been printed in The Daily Telegraph, a fairly conservative newspaper that would have wanted to promote nationalism and preserve our countries remaining war heroes via our memories, and show that ââ¬Å"weâ⬠are in fact a fearless nation! It is a very factual piece, and contains very short, and ââ¬Ëto-the-pointââ¬â¢ paragraphs. The title itself, a seemingly ââ¬Ëdullââ¬â¢ and ââ¬Ëuninspiringââ¬â¢ title, gives us an almost immediate insight into the lack of emotion within the text. The purpose of this text is to chart Captain David Goodwinââ¬â¢s career and life, although we are told little about his life outside of his career. It shows his involvement within the war, and highlights his achievements. This article focusââ¬â¢s in on the ââ¬Å"bestâ⬠part of his life, his naval career sea command. It can also be considered to be a genuine mark of respect, seeing as it is an obituary. I thought that it might also be a form of war propaganda, as it makes the war seem exciting and fun. It certainly portrays Captain David Goodwin as being a war hero. The quote included in the article, ââ¬Å"one horrid little man firing at usâ⬠emphasizes the valour of him. He is referring to the Italian army as if they were a joke. The text starts off by stating his personal records, such as his age. It then gives a brief overview of his involvement in the war and the awards/medals that he gained. The author of this has done this so that we know what type of person we are dealing with, from the very second that we begin reading the text.

Harriet Martineau and the Conflict Theory Essay
When I look over the theories we have discussed in our text: functionalism, symbolic interaction and conflict, I think the one I relate to best is the conflict theorist. The conflict theorist that I agree with the most is Harriet Martineau. She was a conflict theorist that the book describes as, ââ¬Å"Scholar Harriet Martineau (1803ââ¬â1876), an English opponent of slavery and capitalism who felt they oppressed women, children, and nonwhites, translated the work of Comte so people could understand the importance of his perspective (Adams & Sydie, 2001). Regarded as a radical in her day, her work was largely dismissed by people in authority.â⬠( Vissing, 2011, chapter2 sect 3 para 13) There were many female activists who were active early on in the field but they were ignored until feminine activists brought it to the attention of the American public arena ( Vissing, 2011). She would best referred to as a conflict theorist. The conflict theory is defined as, ââ¬Å"a theory that assumes that the institutions and interactions within society foster inequality and competition, and when they are challenged, then beneficial social change can result.â⬠( Vissing, 2011) Our text states that Harriett Martineau was a feminine activist and also was an activist for children and non-whites. Our society has changed greatly since the 1800ââ¬â¢s and without people like Mrs. Martineu , I ,as a female, would not have the advantages I have today. Things like voting, and equality in the work place have helped women and minorities project their viewpoint into the system we have today. These activists stroved for fair working laws which would keep women in the 1800ââ¬â¢s and early 1900ââ¬â¢s from being mistreated and used. Also another importantà thing the feminine activists fought for was birth control and abortion as an option to females, so that they may work or pursue personal goals and interests. The belief in conflict theory is that there must be a challenge to the systemà and the way things are in order to activate change, and from what we can tell in the past this has been an effective tool in the slow processes of equality. Another thing that Harriet Martineau did was take the works of Auguste Comte and put them into laymanââ¬â¢s terms for the average person of the time could understand. Auguste Comteââ¬â¢s beliefs were that we should look at observable facts in order to study society, not just the cultural beliefs.â⬠His concept of positivism holds that there is nothing that canââ¬â¢t be accurately studied if the right methodology is employed. If we try conscientiously enough by employing the scientific method, most things can be studied and understood.â⬠( Vissing, 2011, chapter 1 section 3 para 3) Harriet Martineau used this idea and applied it to the progression of equality for women children and non-whites. In Harriet Martineauââ¬â¢s life she was brought up in a comfortable middle class family, and was denied some education because of her sex. When her father died she was faced with sever economic loss and for once felt what it was like to not have the conveniences of a middle class family to hide in. She was engaged to be married but her fiance fell ill and she was ââ¬Å"savedâ⬠from a married life. She was single for the rest of her life and face living and earning a living in a patriarchal society. She soon was face with some uncomfortable things and rather than accept them and conform she invoked change within our society by making the plight of women, children and non-whites a mainstream problem that needed to be corrected. Martineau was a Unitarian in religion and at first had a very strong religious viewpoint on the world and society. (Hill, 1991). There are many things that I agree with Martineau on such as that all people should be treated equal and fairly. Another of her main ideas was that non-whites should be treated fairly and with the same respect and dignity that whites were given. She also believed that women children and nonwhites should be able to vote to give their voices some power and that they be offered a chance at education and opportunities for work as well and earn an income whichà provided them with sense of freedom and self sufficiency. In America we would not be the culture we are today without activists such as Harriet Martineau. There would be no women CEOs, we would have no choice other than abstinence when it comes to birth control. Many women died because abortion was illegal and they sought backdoor clinics and at home methods of there own to rid themselves of an unwanted pregnancy. Another important issue that was resolved due to activists initiating equality into our culture not only for every white man but for every person regardless of race, gender, age or religoud preferences. Today we are treated equal in most instances and when not the issue is usally irradicated quickly. In my opinion the conflict theorist had the right idea, without conflict or differences in the way society is run there will be no need for change. If there is someone who feels like things need to be changed we must bring that issue to the people and make it known because not all inequalities are suffered by the same people and unless you have been never been treatedà unfairly then you know how it feels to not be able to do something or say something justà because of who you are not what you have done. Our merits should be what we are judged on and not by what someone stereotypes us as being. We have come a long way as a culture but as long as there is a society we will always have some form of fight on our hands to ensure equality for allà people, and it seems to me that the conflict theory is the best way to do this. Entertainment Law Essay
The issue at hand is whether Mary, through a contract with Mr. Shifty, Dream Works Pictureââ¬â¢s Vice President of Production, is entitled to compensation. (Rule) By meeting the standards of the six elements an agreement, consisting of an offer and acceptance; consideration; capacity; legal purpose; genuine assent; and writing, if any. Mary Asher has a valid, contract with Mr. Shifty, a representative of Dream Works Pictures. Agreement, the first of the six relevant elements, is a meeting of two or more minds in regard to the terms of a contract. The process of agreement usually involves two steps. The first step is offer. An offer is a promise or commitment to perform or refrain from performing some specified future act made by the offer. Secondly ,is acceptance by the offeree either in the form of words or of conduct, which indicate agreement to the terms of the offer. An offer may be made to the general public, but no person can accept such an offer unless he knows that the off er exists. Mr. Shifty indeed entered into an agreement with Mary. His offer was indication of willingness to enter into a contract with her. The agreement consisted of him to observing her storyââ¬â¢s synopsis. Consideration is the second of the mention elements. Consideration is Value given in return for a promise. Consideration must be (1) legally sufficient and (2) bargained for by the party receiving it. Legally sufficient is a consideration may take promising, performing and refraining. Consideration is bargained for if it is sought by the promisor in the exchange for the promisorââ¬â¢s promise and the given the promise in exchange for the promisorââ¬â¢s promise. A bilateral contract is an exchange of promises. Thus, each party is both a promisor and a promisee. The promises are binding provided there is either a legal benefit to the promisor or a legal detriment to the promisee. Each promise is the consideration for the other, which is referred to as mutuality of obligation. Mary and Mr. Shifty made a bilateral contract to one another. Therefore, they had Mr. Shifty had an obligation to Mary. Capacity, is three relevant elements, is challenged in terms of Maryââ¬â¢s age. However, her age has no effect on the validity of the contract. According to the law, a minor or a person who is under the age of legal majority, eighteen in most jurisdictions, is considered to possess legal capacity. Liability is any contract involving a minor is voidable. Further, the contract is only voidable by one of the parties, the minor entering into the contract. . The exercise of a minorââ¬â¢s power to void a contract is known as disaffirà ¬mance. As mentioned, a minor has the ability to void a contract at his or her own discretion. A minor may disaffirm a contract at any time before reaching the age of majority. Also, unless already ratified. The individual has reasonable time after he or she becomes of age to void the contract. Ratification can occur in three ways: (1) express, (2) implied Liability for necessaries deals with items that reasonably supply a personââ¬â¢s needs. Minors are liable for the reasonable value of necessary items, which may be different fro m the contract or selling price. Necessaries include products that the minor needs to maintain a reasonable lifestyleâ⬠. By offering to look at her synopsis of a story, Mr. Shifty indeed entered into an agreement with Mary. His offer was indication of willingness to enter into a contract with her. Both parties agreed on an oral agreement. Legal purposes, is the fourth element. It falls under unconscionable contract and substantive unconscionability. Unconscionable contract is contracts that contain terms that are unfairly burdensome to one party and unfairly beneficial to the other. Substantive unconscionability arises when the contract contains term that deprives one party of the benefit of its bargain or of any meaningful remedy in the event of breach by the other party. Mr. Shift took all of the beneficial advantages of Mary synopsis story. Leaving Mary with unfair burdensome. Genuineness of assent the last relevant element is a party who demonstrates that he or she did not genuinely assent to the terms of a contract may avoid the contract. Genuine assent may be lacking due to mistake, fraudulent misrepresentation, undue influence, or duress. The true contracts entered is a lacking contractual capacity, contracts lacking genuine assent are voidable, not void. (Application) In this problem, Mary was a minor at the time she and Mr. Shifty made an agreement. The agreement consisted of him to observing her storyââ¬â¢s synopsis. He accepted by grabbing her hand, giving her a wink, and saying, ââ¬Å"anything you send I accept.â⬠The next day she mailed the synopsis to him. A year later he produced a movie by Dream Works that was identical to Maryââ¬â¢s story involving the scientistââ¬â¢s experience in the Arctic. Now she has reached the age of majority and can ratify the contract with Dream Works Pictures. As a result, Mr. Shifty is entitled to compensation through a contract with Mary. (Conclusion) Therefore, since they both parties agreed on the oral agreement and she was a minor at that time there is a valid contract with Mary and Mr. Shifty.

Free Essays on Aristotle & Virtue Of Ethics
Aristotle was an ethicist who established a fundamental moral theory knows as ââ¬Å"virtue ethicsâ⬠still widely, applicable today. His ethics had to do with matters of character and virtues, which produce good character traits. According to Aristotleââ¬â¢s book Nicomachean Ethics, some things are good because they lead us to other goods that we desire, some things are good, and at the same time, the means to a good end. On the other hand Aristotle said that evil is a deprivation of some good, thus when someone does evil it is a deprivation or lack of god within that person. In order to develop good character traits the virtues should be introduced to an individual at an early age. There are four cardinal moral virtues are practical wisdom, a sense of justice or fairness, self restraint r self control and having courage under duress. There are also many secondary moral virtues like honesty, sympathy, understanding, forgiveness etc. Having these virtues introduced to a child will give them the ability to reason and know the difference between good and bad. The virtues are essentially good character traits and they become a habit. Free Essays on Aristotle & Virtue Of Ethics Free Essays on Aristotle & Virtue Of Ethics Aristotle was an ethicist who established a fundamental moral theory knows as ââ¬Å"virtue ethicsâ⬠still widely, applicable today. These virtues are the ones introduced in our schools today, which provides a reinforcement for some children who are being thought morals at home and for others that are not exposed to them at all. Scientists discover the forces that give geckos their adhesive properties essays
Scientists discover the forces that give geckos their adhesive properties essays Scientists Discover the Forces that Give the Gecko its Strong Adhesive Properties To better understand the adhesive properties of the gecko, scientists have discovered new data that explains how the gecko can attach itself to almost any surface. They specifically studied the Tokay gecko (Gekko gecko). Researchers at the University of Berkley, have been working on discovering how the gecko can walk on almost any surface without falling off or leaving any residue. This research has yielded new data that has given researchers new ideas about adhesive technology. The researchers had to design special micro-instruments to measure the extremely small forces perpetuated by the small hairs, or setae, on the geckos feet. They found that at the end of these setae there are small pads, or spatulae. Geckos can have anywhere between hundreds to thousands of these setae on each foot. The data gathered indicated that the forces responsible for the geckos adhesive properties were Van der Waals forces. By definition, Van der Waals forces occur when two surfaces become e xtremely close to one another so that their respective electronegativity causes them to bind with a great amount of strength. The spatulae can get extremely close to the surfaces upon which geckos walk and this allows the Van der Waals forces to hold with an exponential amount of energy. Being stuck to the surface has not been the root of the problem. It was more important to the researchers to find out how the gecko can get free of the Van der Waals forces so quickly. They reported that geckos adhere and remove these forces up to 15 times a second. It was discovered that the gecko uses a special technique of peeling its feet off at approximately a 30 degree angle with each step. This new discovery gives scientists hope for developing new technology in powerful adhesion without residue. ...

Synthesis and Electrochemical Characterization of Niobium Pentoxide/Carbon Nanotubes Composites
Synthesis and Electrochemical Characterization of Niobium Pentoxide/Carbon Nanotubes Composites Introduction In the last few years, a range of energy-storage device applications has expanded from portable electronics to large-scale energy storage systems, including renewable energy storage and electric transportation [1,2]. To fulfill the energy and power density requirements for energy applications, many researchers have given attention to the synthesis of nanomaterials based on oxides due to their chemical, physical, optical, and electronic properties [1ââ¬â4]. In this way, niobium pentoxide (Nb2O5) is a promising candidate because of its semiconductor properties with a band gap of ~3.4 eV, n-type, low toxicity, surface acidity, and good chemical and thermal stabilities [3,5ââ¬â8]. It has been demonstrated that Nb2O5 can deliver high power through a mainly pseudocapacitive reaction of Li-ion (Li+), which could occur not only at the surface but also in the bulk of the Nb2O5 nanocrystals in non-aqueous Li+ electrolyte [2,9]. Moreover, the intercalation pseudo-capacitive behavior was highly dependent upon the presence of a crystalline structure, where amorphous and pseudo-hexagonal (TT-Nb2O5) exhibited lower specific capacitance values than the orthorhombic (T-Nb2O5) phase, however, nanoparticles aggregation is inevitable due to the high calcination temperature (>600 à °C) for the orthorhombic phase formation of Nb2O5 [10ââ¬â17]. Nonetheless, the application of Nb2O5 has been hampered by low bulk electrical conductivity (~3.4Ãâ"10-6 S.cm-1 at 300 K) and by the difficult control of the ideal crystal structure [3,10,11]. Therefore, when T-Nb2O5 nanocrystals were fabricated into a relatively thick electrode, the power performance would be limited due to the impaired mobility of electrons. A possible effective method to improve these adversities in Nb2O5 is through of surface modifications (e.g., carbon coating), which could expose more redox active nanoparticles to the electrolyte as well as greatly i mprove the electronic conductivity [1,3,11ââ¬â13]. It must be noted that the introduction of multiwalled carbon nanotubes (MWCNTs) networks can enhance electron transport of the Nb2O5 and further improve the rate capability. Physical mixing of MWCNTs and Nb2O5 nanoparticles can fabricate composite with improved conductivity, but this type of mixing fails to fulfill a good interfacial interaction between the MWCNTs and Nb2O5 [3]. Wherefore, soft-chemistry methods like oxidant-peroxo method matched with hydrothermal treatment and heating by microwaves could be a promising alternative for niobium synthesis, mainly because it is performed at low temperatures which avoids the elimination of the hydroxyl groups in as-formed surfaces resulting in a material with high surface area and greater number of acid sites [6,18,19]. In addition, carbon materials have a good microwave radiation absorption, which facilitates the interaction with other particles [20]. The use of niobium oxides for energy storage devices is already well known and exploited [21] but its performance is only obtained by a hybrid supercapacitor based on lithium intercalation processes [21] where high values of energy and power density are obtained. These intercalation processes require the application of potentials between 1 to 3 V vs. Li/Li+, a careful and humidity-free assembly scheme and non-aqueous electrolytes [16]. In this work, niobium pentoxide with different structures and morphologies were grown onto the surface of carbon nanotubes were synthesized by MHS. Moreover, we evaluated some electrochemical properties of electrodes with high mass loading on Ni foam current collectors (Fig. 1) using aqueous electrolyte, which brings the material closer to real and practical applications. Methods The acid functionalization on the MWCNTs was performed to create functional groups through a controlled functionalization of the nanotube walls, which allowed the anchoring an d growth of the Nb2O5 nanoparticles. This functionalization is accomplished by exposing the MWCNTs in a concentrated HNO3/H2SO4 (1:3) as described by Goyanes, et al. 2007 [22]. Nb2O5 nanoparticles were synthesized by the microwave-assisted hydrothermal method followed by a heat treatment. The sample preparation started with the dispersion of the 50 mg of functionalized MWCNTs and 100 mg of SDS (1:2) in 100 mL of distilled H2O in an ultrasonic bath. After dispersing, 2 g of (NH4[NbO(C2O4)2(H2O)2]à ·nH2O) and 1.6 mL of H2O2 were added under ultrasound frequency. The solution was ultrasonicated continuously for 30 min and then poured into a Teflon vessel reaching about 50% of its volume, the autoclave was sealed and heated in the microwave equipment (Electrolux, MEF41, Brazil). The synthesis was performed with amendments according to Marins, et al., 2017 [23], where the temperature was set at 160 à °C during 30 min, under a constant pressure of approximately 6 kgf cm-2 using 2.45 GHz microwave radiation with a maximum output power of 1500 W. Temperature and pressure during synthesis were monitored and controlled with the aid of a shielded thermocouple inserted directly into the vessel and with a pressure transducer sensor connected to the vessel [5]. After cooling at r oom temperature, the obtained powders were washed and centrifuged at 5000 rpm six times with distilled H2O to remove unreacted reagents and surfactant. The washed powder was over dried with no air circulation at 50 à °C for 48 h. This sample was identified as CNT+TT-Nb2O5. To obtain the samples under heat treatment, part of the powder was heated in a furnace (FT-1200 1Z, Fortelab, Brazil) at 400 à °C for 120 min and 650 à °C for 180 min with a heating rate of 10 à °C/min under nitrogen atmosphere aiming to get the orthorhombic phase [12,22]. After cooling at room temperature, the powders were stored in an oven with no air circulation at 50 à °C and identified as CNT+T-Nb2O5. PVB solution in ethanol was added to the mixture in the electrode preparation. The PVB content in the slurry was 3% of the total mass of Nb2O5 and MWCNTs to each sample. The obtained slurry was used for the impregnation of Ni foam current collectors with area of 1 cm2. The active mass loading was 32 mg cm-2.

Make for me - Essay Example In the poem ââ¬Å"A Letter To Sir John A. Macdonaldâ⬠, Dumont writes about the wrong things that politicians and businessmen did in the history of Canada. For me, the case is not only true for Sir John A. Macdonald, but also to countless other men who have done corruption and performed wrongdoings to the country. She begins the poem quite ironically, ââ¬Å"Dear John: Iââ¬â¢m still here and halfbreed,â⬠the irony is because she is proud to say upfront that she is a halfbreed, while other people look down on such halfbreeds. She has also emphasized her being a halfbreed, or Metis blood meaning that she is a mix of Caucasian and Americanà Indian ancestry, in the ending where she says ââ¬Å"weââ¬â¢re still here and calling ourselves halfbreedâ⬠. In order to properly appreciate this poem, one must have some knowledge of Canadian history, particularly on the construction of the Canadian Pacific Railway, as well as the Metis uprisings. The railway was shutdown and never used, and what Macdonald did left scars in the people. Dumont pointed this out in her lines ââ¬Å"because you know as well as I that we were railroaded by some steel tracks that didnââ¬â¢t last and some settlers who wouldnââ¬â¢t settle and itââ¬â¢s funny weââ¬â¢re still here and calling ourselves halfbreed.â⬠Their history was one of oppression by a more pure race who looked down because their blood was mixed with different races. As for R. Zamora Linmarkââ¬â¢s poem, it was around 1998, after the filming of Brokedown Palace in Manila, Philippines, that Claire Danes, in an interview with Premiere Magazine, said that "The city just fucking smelled of cockroaches. Theres no sewage system in Manila, and people have nothing there. People with, like, no arms, no legs, no eyes, no teeth.? Rats were everywhere...a ghastly and weird city." This prompted R. Zamora Linmark to write the ironic poem ââ¬Å"A Letter to Claire Danes from a Fan in
Public Health Advocacy And Preventive Medicine Essay
Public Health Advocacy And Preventive Medicine - Essay Example This encompasses upholding individual rights and freedoms in relation to accessing healthcare services (Landesman, 2005). To me, health advocacy also entails speaking out for minority groups, and further airing my views and opinions that are highly likely to reform healthcare system for the better. Health advocacy has had a significant impact on my personal life. This issue has shifted my healthcare concerns from an individual perspective to a social and global context. In other words, there are diverse and dynamic healthcare issues that remain unaccounted for by health advocates. If every advocate plays his or her role, then the outcome will without doubt be overwhelming. Health advocacy has, therefore, resulted in self-actualization in the advocacy pursuit. In my own community, Hospital Acquired Infections HAIs constitute a health advocacy need. While many patients have succumbed to HAIs among other hospital errors, inadequate attention is directed to them (Landesman, 2005). Personally, I would actively become involved in advocacy activities related to HAIs since few or no patients understand their

Across the nursing field Jean Watson is widely known for her expertise in human caring and science. Her contribution in this field led to her publishing of the Jean Watsonââ¬â¢s theory on human care. The theory is known as the caring theory which was published in 1988 (Johnson & Webber, 2010). The theory was published in the journal of human science and human care. The rationale of choosing the theory In the selection of the theory and theorists, this particular theory is rare in the field of nursing. Few scholars have made progress in coming up with satisfactory detailed publ ication on human care. According to Johnson & Webber (2010) human care is a neglected field in the medical field. The author further argues that human care is one delicate field that explains the existence of numerous medical relationships between patients and their medical practitioners. Human care is also an inclusion of other modes of medication apart from the ordinary medical care (Hiott, 2010). Human care theory is a grand range theory. The Caring Theory While creating the theory, Watson had in mind the motive to capture the medical essence of not a pat3eint but the human environment of the patient. To be able to achieve this, she included family care and support in the theory and highlighting how important family care is in regards to patient recovery. In words by Johnson & Webber (2010) the caring theory creates and emphasizes on the humanistic aspects of nursing but also with the consideration of scientific knowledge. The general motive of the caring theory is improving the medical and social relationship between patients and nurses. The theory by Watson gives duty to nurses as follows: Create a healthy relationship with the patients. Approach patients with a positive motive Promote health through intervention and medical knowledge Spend significant amount of time with the patients Accept the condition and the patient regardless of their status. Treat patient like innocent and holy creatures Have a positive stature in mind, body and spirit when approaching patients Instill hope and faith in patients Assistance in the acquiring of the basic needs In words by Hiott (2010) the mood of a nurse in a room is responsible for the perception of a patient towards the environment. It may be bright, dull, small, threatening or secure. The author further explains that these provisions of the caring theory give so much authority to nurses to make patients comfortable in the medical institution setting. The theory is based on four concepts: human being, health, envir onment or society and nursing Johnson & Webber (2010). Human being refers to the patients in need of care and medical attention. Health refers to the medical condition of the patient the type of medication the patient is in need of. The environment refers to the provisions of the WHO regarding proper handling and state of medical institutions Johnson & Webber (2010). Nursing is concerned with provision of healthcare and taking care of the patient. Classification of the theory In the creation of

Exploratory - Essay Example Of course, it would be a misplaced conception to assume that these games are the same. What are the differences between the major gaming platforms, for instance the Wii and Playstation3? With the overwhelming market expansion, the most important question that lingers in many minds of course would be what exactly is driving the gaming console industry to its new levels of success witnessed in the recent past? I sought to find out by engaging merchandisers on one on one interviews, conducting a library research and consulting articles posted over the internet. The first thing I did to find information on this particular subject was to set up an interview with Mr. Jimmy Jonson, a Caltech undergraduate working on Kinect home applications based in Washington. ââ¬Å"How do I get to know the best gaming platform that best suites me?â⬠I asked. ââ¬Å"There are numerous different types of computer gaming systems available for sale in the market currently and so choosing the right one that suit ones needs can indeed be a difficult process. As such, a potential buyer with interest should first outline the goals to be met before actually making the final decision to purchase. à Some of these goals include setting a price ceiling, the possibility of having the device playable to two or more people, ability to be able to play online, and the rating in the consumer market so as to be moving with the current technology, as opposed to using obsolete systemsâ⬠(Jimmy Jonson, part 1). With major preferable gaming consoles to select and abundance of video games powered by different industries, it would be an experience of a kind should one decide to enter the world of video or computer gaming. The price tags, game genres, as well as the game consoles, there are simply so many options that one has to consider before officially launching a bid to secure one. And so to avoid the baggage of focusing on quite a huge number of the gaming

According to Aristotle, it is the attainment of happiness, for it is that alone that we seek for its own sake. Based on Aristotle assertion a woman bearing a child is good. For J.S. Mill, decreasing pain and increasing pleasure is good. However, not all pleasure is the same. Mill argues that intellectual pleasures are superior to bodily pleasures (Mill, Utilitarianism, and Chapter 2).ââ¬Å"Act only on that maxim whereby you can at the same time will that it should become a universal law.â⬠Basically made poor decisions or ethical decision based on rational thinking. The theory that the value and especially the moral value of an action should be judged by the value of its consequences. The ethics of care is a normative ethical theory; that is, a theory about what makes actions right or wrong. What path or rule do you follow to achieve the good? (1ââ¬â2 sentences) Aristotle ââ¬â Virtue EthicsMill ââ¬â UtilitarianismKant ââ¬â DeontologyConsequentialismNodding ââ¬â Care EthicsFor Aristotle, virtue is the way to achieve the good. Moral virtue is a state of character and can only be acquired by habit. In other words, we need to practice being morally virtuous in order to be virtuous. Aristotle describes moral virtue as a mean. We act morally, if we do the right thing, at the right time, ââ¬Å"with reference to the right objects, towards the right people, with the right motive and in the right wayâ⬠(Nicomachean Ethics, Book II, 1 and 6; see also Moore and Bruder, 2011, p. 265).Utilitarianism advocates maximizing utilities and moral evaluations of public policies. It helps explain why some people actions are generally wrong and others are generally right and he influenced ethical decisions. The deontology refers to moral obligation. As we made the decisions that life must understand the one right is important even though everyone is tomorrow wrong always do right regardless.I think by taking in consideration the moral value and the actions the standard display when making decisions. Understanding the consequences to see the decision if not follow out a law of land.It is important to love thy neighbor. It sounds a little clichà © its however basically we should live our life each day by exercise the care ethics system. This belief was pretty good for us as defined by our natural objective. His requirement was basically reducing pain that will actually increase pleasure. In essence making sound decisions based on bodily pleasures. And Kants theory the deontology base is the study of moral obligation. As we are responsible for our actions and doing what right at all times. The first assumption is that after all is said and done, only the results of our actions remain, therefore, the results are what a moral theory should focus on. The second assumption is that we love others as much as we love ourselves. This assumption means that we will act to promote the overall good, so long as that action ââ¬Å"does not hurt others moreâ⬠(Haines, 2006).First we must display some level of sensitivity to be able to exemplify d esires spirit. We are responsible up in our brains keep a careful one of the actions is careful and must consider the feeling that so that we dont interfere with you making ethical decision. Provide an example of how this ethical theory might work (5 or more sentences) Aristotle ââ¬â Virtue EthicsMill ââ¬â UtilitarianismKant ââ¬â DeontologyConsequentialismNoddings ââ¬â Care EthicsVirtue ethics is a theory used to make moral decisions. It does not rely on religion, society or culture; it only depends on the individuals themselves. The main philosopher of Virtue Ethics is Aristotle. His theory was originally introduced in ancient Greek times. Aristotle was a great believer in virtues and the meaning of virtue to him meant being able to fulfill ones functions The utilitarianism works in determining consideration of right conduct should be useful of his consequences. This spectacle theory is basically based off the fat that is largely possible ability of balance pleasure over pain. This action should take a lot of consideration which the way we made the decision about disciplinary action on people or even animals. It was said that the actions of sacrifice and people or animals is wrong. So drawn my friend coworker on the bus and a heated argument with display that ethics. The deontology is the basis of more action duties. The principle of goodwill is what makes people act for duty, and acting for duty given them action of more value. However the action does not take into consideration the consequences thereof. From the consequentialism also known as the idea of the therapist is less and this chapter we discuss the beauty and friendship as well as pleasure that one should aim towards maximizing on. Lovely decision in my life and ethical way to maintain friendship even though that means sometimes being completely honest with a friend. It is very important that we made the decisions that will be conducive to our morals and ethical background. As a result thats the beauty of the virtual ethic. My best friend comes to me asking for advice. She is having problems in her marriage and just found out she is pregnant. Due to the economic downturn, she may lose her job in the coming months. Her relationship with her husband is strained and is having a serious emotional toll on her. She is considering an abortion. I am the carer and she is the cared-for. I do not consider her unborn child because my friend is the one in immediate pain or peril. I recommend counseling. I also try and gently ask question s to see what options she has and what she has thought about. I do not tell her what I think she should do in this case or what I think is right or wrong. I only ask how I can help her.

Definition of management
Definition of management Executive summary The constitution of the people in an organization which includes planning, organizing, leading, motivating and controlling at all levels of the management. An introduction to a variety of tools, idea and system that are used to analyze and understand the inside and outside of business environment of a firm. Management In the simple term refers to making things done by others. History The word manage come from the Italian word maneggiare which means (to handle -especially a horse), which in turn derives from the Latin word manus (hand). Later on the French word mesnagement (later menagement) influenced the development in meaning of the English word management in the 17th and 18th centuries. (www.answers.com) (www.encyclopedia.com) FINDINGS:- Definition of management:- ââ¬Å"The conventional definition of management is getting work done through people, but real management is developing people through workâ⬠By ââ¬ËAgha Hasan Abedi Management is defining both science and art but thats not so important, what important is? Management is a method that is used to achieve organizational objective; that is, a method that is used to attain what a firm wants to achieve. A business can be in any field or entity or any group in which people come together to perform their respective task. Managers are the person to whom this task is given. And thus the managers achieve these goals through the key function like (1) planning, (2) organizing, (3) directing, and (4) controlling. The HSBC Group has an international history which is unique. Many of its most important companies opened for big business over a century ago and they have a history which is rich in diversity and success. The HSBC Group is named after its founding member and the founder of it was Sir Thomas Sutherland, The Hongkong and Shanghai Banking Corporation Limited and a public limited company, which was established in year 1865 to finance the growing trade between China and Europe. It was started as it headquarters in hongkong and than until 1992 hongkong served as a world headquarter when it was forced to move to London as a condition of completing the acquisition of midland bank. As a public limited company hsbc is listed on different stock exchanges of the world like London, hongkong, Paris, India, Bermuda constituent of the FTSE 100 Index and the Hang Seng Index. (www.HSBC.co.uk/history) INFORMATION SYSTEMS IN USE AT HSBC FOR THE TRADING PORTAL HSBC was a founder member of the ââ¬ËFXall software, the leading multi-bank FX trading portal. With increasing competition in electronic FX trading, HSBC wanted to be the first bank to introduce the new QuickFill functionality software. QuickFill enables customers to execute trades based on streaming Prices i.e. using configurable deal sizes for different currency pairs as opposed to a request for quote (RFQ) system where a deal is executed against the best available quote in the market. QuickFill allows customers to see a price and simply ââ¬Å"hitâ⬠it. The system provides a 24/7 operation base with rates being managed globally from a range of HSBC financial centres. This software enhances functionality to enable streaming prices, rapid implementation within an infinite timeframe, and transfer of required details over multiple levels and minimized the risk by strict project planning. Structural and contextual dimensions of HSBC Structural dimensions: Centralization:- This means the extent to which functions are dispersed in the company, either in the terms of integration with other functions and geographically. Since HSBC is a worldwide banking corporation all functions are dispersed into different departments under different heads. In such conditions centralization is not possible and so the entire organization functions are de-centralized so as to make the functioning easier and smoother. Formalization:- This concept is regarding to the extent of policies and procedures in any organization. HSBC being a highly accredited name all over the world, it is very important for the management to upkeep its name and standard in the world wide market place and so for this reason it is essential that formalization levels in the company be very high. This company deals with high profile clients and so every employee must be aware of all the rules and regulations of the company so as to avoid reduction of reputation in the eyes of the customers. Hierarchy:- This concept is regarding the extent and configuration of levels in the structure of the organization. Hierarchy of a bank at the stature of HSBC is very complicated as it involves both a flat as well as tall structure hierarchy and level of management. Basically, the bank tries to follow a flat structure and has decentralized all its departments so as to increase efficiency and productivity of the organization. Specialization:- Specialization refers to the extent at which activities are refined in the organization. Like any other multi-national corporation even HSBC has a high amount of specialized employees working under different departments from different fields and educational backgrounds. The company advocates a policy of well defined tasks and roles for each employee so as to avoid overlapping job portfolios. Training:- Training is the extent at which activities to equip organizational members with knowledge and skills are carried out, about their roles. Before an employee can be sent onto the floor to handle customers each employee has to undergo various trainings so as to be fully equipped with complete knowledge over all the queries that a customer might have. This training is highly professionalized so that no errors are made on the side of the employee who would result in the loss of a potential or existing customer. As this is in the banking sector low professional training standards are not advised and harmful for the company. Contextual Dimensions: Culture:- The values and the beliefs shared by all employees in the organization should be maintained in decorum. Culture is often explained by examining the norms and behaviors of employees in the workplace. HSBC has a multilingual culture where persons from all over the world come together and work in a single workplace as a team. So, its said that ââ¬ËHSBC- THE WORLDS LOCAL BANK. Environment:- Environment refers to the nature of external influences and activities in the political, social, technical, and economic areas of business. A stable environment is very essential for any business to survive and function smoothly in a way as per norms written down in the memorandum of association. Being a world wide bank it is very difficult to say that HSBC has a stable environment as it might have a stable environment in one of its branches but that is not the same with each and every one of its franchised branches. Goals:- The unique overall priority and preferred end-states of the organization is known as its goal. The goal of the bank is ââ¬Å"To be the Bonding Company that guarantees continuance in the market to satisfy appropriately and professionally the bonding needs of our obligors and the assurance of timely fulfillment of our bond to our beneficiariesâ⬠(www.hsbc.co.uk). Size:- The number of people and resources in the organization and their span of control in the organization. HSBC is a highly resourceful bank and has the most number of employees in comparison to any other bank. Basically, we can say that HSBC is a large multinational corporation with around 8500 offices over 119 countries which consist of more than 1 million employees and workers. Technology:- The unique activity needed to reach organizational goals, including nature of activities, specialization, type of equipment/facilities needed, etc. HSBC provides their customers with both products as well as services. The main technologies includes computer softwares and banking instruments which have made modern life un-livable without. SWOT ANALYSIS ââ¬Å"Situation analysis in which internal strengths and weaknesses of an organization, and external opportunities and threats faced by it are closely examined to chart a strategy.â⬠(www.businessdictionary.com) STRENGHTS:- Competitive market and brand name. High standard regulatory environment Flexible work permit system and good quality staff offering personal client service WEAKNESSES:- Tough competitors Retail and staff affluent customer proposition Lack of legitimate access to all markets Rigid laws that prohibit development OPPORTUNITIES:- Brand expansion Unified trade body to lead finance sector program change Active and aggressive targeting of private and corporate clients Co-ordinate business relationships thus investing in the ecosystem THREATS:- Changing scenario which makes investors hard to invest. Outsourcing to cheaper jurisdictions Downsizing and reduction in banking operations Regulations in foreign trade capital markets Impact on the service sector ecosystem Conclusion Service sector management is an important factor for any business organization and with the rapid growth of these sector people are keener to develop the habit of providing services with all the necessary means available to them. Due to high competition in the service market people are scared to invest in banking sector, hsbc have always arrived up with various schemes to hold the interest of its customers. As mentioned: High competition in the banking sector, hsbc has to increase the confidence in the mind of their customer about the reliability and security of their investment compared to other banking service provider. Best service compared to the other providers. Hsbc should be more concentrative in after sales service, There is opportunity but no security; it should emphasis more on service than any other thing. Hsbc should give some more sound strategies to trap more customers giving more comparison with other investment center. Due to uncertainty of market hsbcs security investment are subject to market risk and there is no guarantee that the objective be will achieved. The growth of retail financial services sector has been a key to the development on the market front. Both the public and the private bank will not only keen to tap the domestic but also to hold the international market of financial services. Now foreign banks will be more likely to gain foothold in prospective global market. Therefore the future will belong to them who develop good and strong service strategies, internal controls cost effective services and instruments and innovating new evolution in the SERVICE SECTOR market.

Influences of a Teacher Essay -- Learning Education Essays
" A hundred years from now it will not matter what my bank account was, the sort of house I lived in, or the kind of car I drove but the world may be different because I was important in the life of a child."-Unknown What does a teacher do? Well, besides giving out tons of papers, numerous tests, and stories that the students aren't interested in reading (or just too lazy to read), teachers are responsible for creating the future leaders of tomorrow. In today's society one may find advancement difficult without a formal education. Education is one of society's institutions that helps to infuse in our younger generation the norms, values and morals of the world we live in. Teachers lead their students on the trip to success. Have you ever wondered how you would have gotten where you are today, or how you will get where you will be tomorrow without a great instructor? According to a private pedagogical survey of sources (teachers and students), some of the main qualities of teachers should be discipline, motivation, and above all, respect. I have interviewed three teachers and three students from the High School, Middle School, and Elementary School levels. How do we define discipline? When most people hear the word "discipline" they imagine an eighty year old, six foot five matron holding a long stick, preparing to give some outspoken child his just punishment. In modern terms, having a disciplined classroom is simply the act of maintaining structure and consistency in the working environment. Discipline is hard to achieve in a class where the teacher and students are viewed as equals. In this form of study, students will tend not to listen to the teacher when the time comes to work or be productive. In his article, " I'll ... ... able to apply what they learned. Just think, the positive influence of a teacher today creates the successful individual of tomorrow. Works Cited Cheney, Lynne V. " P.C. Attention Deficit Hyperactivity Disorder and the Student Essay
Attention Deficit Hyperactivity Disorder and the Student Attention Deficit Hyperactivity Disorder (ADHD) is one of the most common obstacles that some students face in the process of learning. ADHD is often confused with Attention Deficit Disorder (ADD). It is very important to understand the difference between ADHD and ADD. It is also very important to understand the symptoms and behaviors associated with ADHD, as well as the causes and treatments available. After a complete understanding of the basics of ADHD, a closer look at the education system is essential. The education of children relies on the teacherââ¬â¢s knowledge of ADHD, as well as parent student teacher relationships. There are also some important teaching tips that teacher can utilize in their teaching experiences of ADHD students. ADHD versus ADD There is one very distinct difference between Attention Deficit Hyperactivity Disorder (ADHD) and Attention Deficit Disorder (ADD). Attention Deficit Disorder (ADD) is no longer the correct terminology. Attention Deficit Hyperactivity Disorder (ADHD) has ââ¬Ëreplacedââ¬â¢ Attention Deficit Disorder (ADD) based on the fact that no two cases are alike. The medical professionals now use the term ADD to describe a set of symptoms and behaviors that are associated with ADHD, but these symptoms are not exclusive to ADHD. With the understanding that ADD is no longer correct terminology, it is essential to understand the symptoms and behaviors that were associated with ADD, and how they relate to ADHD. Symptoms and Behaviors With five percent of the children in the world affected by ADHD to some degree, there is much variance in the severity and occurrence of symptoms and behaviors (Zeigler Dendy, 2000, ââ¬Å"Teachin... ...de Web: http://www.add.org Department of Education (2002, August). Pinnacle Manufacturing Part
Part I. c ââ¬â Summary of Observations Including Assessment of Business Risk Based on the financial ratios calculated, it appears that Pinnacle Manufacturing (the ââ¬Å"Companyâ⬠) is both using up cash assets and increasing its debt. The Cash Ratio has declined each of the past three years indicating that the Company has a decreasing ability to pay its current liabilities from cash and will be required to liquidate assets to pay off current liabilities. The Current Ratio has also declined each of the last three years. In 2009, it was 218. % or 2. 186. This means that for every dollar of current liabilities the Company had $2. 18 in current assets with which to pay those liabilities. Inventory Turnover has declined from 4. 04 times per year in 2009 to 3. 78 times per year in 2011. This would seem to indicate that sales are slowing and inventory is not being sold as quickly as in prior years. This is further supported by the increasing Days to Sell Inventory number. In 2009 D ays to Sell Inventory was 90. 44 and had grown to 96. 48 days in 2011.This makes it important to assess inventory obsolescence in light of these numbers. Debt to Equity has increased significantly from 2009 to 2011. In 2009, the Debt to Equity Ratio was 70. 81%. In 2011, it had grown to 96. 48%. This might indicate that the Company does not have room to continue to borrow should it need cash to operate. If borrowing is not available as a financing tool, it is likely that the Company might need to look to its stockholders for additional cash or resort to more costly forms for financing. Gross Profit Margins have declined from 29. 1% in 2009 to 27. 5% in 2011. This ratio is helpful analytically to indicate that possible misstatements might exist in the areas of sales, COGS, A/R and inventory. As noted above there is already a negative trend in inventory for the Company. Similarly, Profit Margin for the Company has declined from 3. 77% to 2. 84% between 2009 and 2011. A decline in prof it margin can signal misstatements in various operating expense accounts and balance sheet items. It can also simply signal a declining business trend for the Company.Return on Assets shows the Companyââ¬â¢s ability to generate a profit based on assets and equity. In 2009, the Companyââ¬â¢s profit margin was 3. 07% and in 2011 it had fallen to 1. 91%. Overall, the Company appears to have slowing sales leading to growing inventory. The Company is increasing its debt burden to help cash flow since sales seem to be declining and inventory is growing. The profitability of the Company is declining steadily. Finally, if the Company finds itself in default of any loan covenants it will have to liquidate assets to pay its debts.Forced asset sales are never beneficial to the seller and would only exacerbate the already declining business trends of the Company. Part I. f ââ¬â What Data is More Useful in Evaluating the Potential for Misrepresentations? We believe that each set of dat a has its strengths and weakness. The balance sheet data available for Pinnacle Manufacturing is extremely helpful in evaluating whether certain income statement items could be misstated. As an example, to know the trend in the asset Accounts Receivable: Trade made evaluating the income statement item Bad Debt expense easier. As a result, the financial data for the parent Pinnacle could be cross-referenced more easily. However, the subsidiary income statements allow greater detail into the business components that make up Pinnacle. A possible overstatement in one account for one of the subsidiaries could be cancelled out by a similar understatement in the in the same account for another subsidiary. When the numbers are rolled-up to the parent company, there might not be a noticeable problem in the account. As a result possible insufficient planning would result. With the subsidiary information, an audit of each corresponding account could result in a more accurate number for the paren t company. This would appear to help acceptable audit risk for the audit firm. ? Part I. g ââ¬â Observations based on Accounts Receivable, Inventory and Short/Current Long-term Debt Accounts Receivable: Trade has grown in absolute dollar amount from just under $9. 6 Million in 2010 to over $14 Million in 2011. As a result, we believe it is important to look at the reasonableness of the allowance for bad debts and bad debt expense.Confirmation of balances with customers will help to uncover any discrepancies between Pinnacle and its customers about amounts owed and paid. This could impact the internal control over posting of payments at Pinnacle and whether the money is being diverted through fraud. Inventory has grown from slightly over $25 Million at year-end in both 2009 and 2010 to more than $32 Million in 2011. Growing inventory could be indicative of inventory obsolescence. Obsolete inventory would be subject to a write-down in value. We would want to explore these areas. We have identified Inventory as an area of possible misstatement for Pinnacle. Short/Current Long-term debt has increased from 2009 and 2010 levels in 2011. In 2009 and 2010, the short/current portion of long-term debt was only $41,070. In 2011 it had increased to almost $4 Million. We are concerned that a misstatement has occurred. If the amount is correct, we would want to ascertain why the sudden increase. If it is due to a scheduled one-time balloon payment being due it is less of a concern than if a loan has been accelerated due to default or failure to meet certain loan covenants. The long-term solvency of Pinnacle depends on the success of its operations to raise capital for future growth and expansion as well as its ability to make payments on its debts. If Pinnacle is in default and a loan has been called or accelerated it would negatively impact the Companyââ¬â¢s ability to borrow in the future. ? Part I. h ââ¬â Going Concern Issue We assess the likelihood that Pinnacl e is likely to fail financially in the next twelve months as low. While many of the items discussed indicate that Pinnacle has some financial problems, its current ratio is still well over 1.It might be holding some obsolete inventory but even obsolete inventory has some value to generate cash. In twelve months, if the Company does not resolve its growing inventory issues and possibly rework some of its debt deals, the decision might be different. Currently, sales are growing as is Income from operations and net income. The Company has a positive cash flow which buys it time to try to fix its underlying problems. Inattention to these details could cause us to revisit this question next year with a more dire answer.

Clive Robertson vs Hal Niedzviecki Essay
There are contrasts between Clive Robertson and Hal Niedzviecki. One is talking about how Artist-Run Centre can run better and it should be continue with younger artist in this century and one is talking about the Art Bureaucracy is ruining artistsââ¬â¢ creativity and decisions. The following essay will be deep discuss each writerââ¬â¢s point of view and the ambitions of art. In Clive Robertsonââ¬â¢s essay, ââ¬Å"Policy Matters: Administrations of Art and Culture, through InFest: International Artist Run Culture, it was held in Vancouver in 2004. He discussed the Canadian artists where they held artist space, artist-run centre or artistââ¬â¢ events during the past and present. Clive said, ââ¬Å"The manifestations of the artist-run culture movement in Canada has been widespread and enduring for many reasons aside from its existence within a particular conjuncture of nation-building through state funding. â⬠(Clive 3) Artist-Run Culture was very active during the sixties and seventies, thatââ¬â¢s why Clive said the art culture movement has been widespread. Clive also discussed what claims to be contemporary art in the essay. Talking about artist-run culture, many people must be confused what that is. For myself, I didnââ¬â¢t know the differences between public gallery, commercial gallery or what artist-run centre is if I see a gallery on the street because the gallery is usually just showing the works. After a deep thought, I realized there are differences between different galleries. Public gallery is like AGO, though you need to pay the admission fee to go in, itââ¬â¢s a museum for you to browse the arts. Museum usually is just for browsing, not purchasing. For commercial gallery, is a private owned gallery where the artists can sell their own works. I didnââ¬â¢t know much of Artist-run centre until I know thereââ¬â¢s Nuit Blanche. Nuit Blanche is a big artist-run centre in Toronto and I think itââ¬â¢s very successful. As Clive said in the text, ââ¬Å"The first thing is that conceptualismââ¬â¢s intellectual currency as an art-making strategy is very much alive; and, secondly that the projects of self-government or self-administration and bureaucracy for artists have to be ââ¬Å"lived throughâ⬠in order to comprehend and assess what rules are in play and which sets of rules provide the most or least acceptable ethical opportunities and advantages. (Clive 2) Artist-run is hard to run it without funding from government or non-profit organizations. So, they think itââ¬â¢s better to run as bureaucracy for artists. They will have a more stable base to run art. Arts need to be thinking out of the box which Designers always been asked to do. Artist-Run Centre keeps on running in different places, but it seems like artists and curators stop discussing about it. The artists and curators from this generation should start to write about the Artist-Run Centre, or else it would just stop as history and thereââ¬â¢s no contemporary anymore. Hal Niedzivecki discussed in the essay, Fear and Loathing on the Granting Trail: Canadian Art Versus Canadian Bureaucracyâ⬠, Niedzivecki said Canadian artists suffers from Arts Bureaucracy Angst (ABA). ABA can ruin the artistsââ¬â¢ life, such as creativity. The world is full of judgments and right or wrong, but it seems like Arts Bureaucracy is not giving artists choices of what they are doing. Niedzivecki had given examples of the artists/writers about their story. ââ¬Å"Youââ¬â¢ll note that Molly Morin learned a reverse lesson: she got her grant, and so was empowered, personally ââ¬â not financially ââ¬â to pursue her poetry and publish her chapbookâ⬠¦. A faceless verdict is issued; lacking context or explanation or encouragement, one can easily mistake that verdict decision ââ¬â ever meant to beâ⬠(Niedzivecki 259) Arts Bureaucracy can be putting some pressures on the artists. People always say being an artist is so poor; youââ¬â¢ll be famous after you died. For artists, they make art because they love to create something through art and they make money from it, but it is hard to make money from doing art. As Niedzivecki mentioned, ââ¬Å"Artists have always needed funding. â⬠(Niedzivecki 259), artists donââ¬â¢t know their art will sell and earn them money. ABA is the ugly, gnawing feeling we get when we sense that our livelihood is under threat by forces ââ¬â global, government ââ¬â that we can neither affect nor predit. â⬠(Niedzivecki 260) Not only artist and designer, basically everything is controlled by the global and the government. You do have the right to make some art or design, but you canââ¬â¢t avoid having judgments or rejections from the global. ABA is totally a discouragement to artist. Niedzivecki could depict the truthfulness and the ugliness of ABA in the essay. In conclusion, contemporary art is not only involve with conceptual art, body art, environmental art, correspondence art, performance art, but itââ¬â¢s include with artist-run centre and arts bureaucracy angst. In contrast between Clive Robertson and Hal Niedzivecki, they both have different points of view of contemporary Canadian art. Indeed, I found a similarity between two authors message is that artists are ââ¬Å"starving artistâ⬠, where Niedzivecki had mentioned in the essay. Artists want to do their best in their artworks and get compliments from others. Unfortunately, the rejections or judgments they get are way more than compliments.
